Welcome to Invita Fiestas. By accessing and using our platform, you agree to be legally bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our services.

These terms apply to all users of the platform, including visitors, registered users, and event organizers.

2. Service Description

Invita Fiestas is an online platform that allows users to create, customize, and share digital invitations for events such as weddings, birthdays, quinceañeras, baptisms, and other special occasions.

The service includes:

• Creation and editing of personalized digital invitations
• RSVP management
• Photo galleries for events
• Sharing invitations via unique links
• Dashboard to manage events and guests
• Visual customization (colors, fonts, images)

3. User Accounts

3.1 Registration

To use certain features of the service, you must create an account. By registering, you agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

3.2 Eligibility

You must be at least 13 years old to use this service. If you are under 18, you must have permission from a parent or legal guardian to use the platform.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account and password. You must not share your access credentials with third parties.

4. Payments and Billing

4.1 Pricing

Invita Fiestas offers a one-time payment model per published event. Current prices are displayed on the payment page and may vary by currency and region.

• Creating events is free
• A one-time payment is required to publish an event
• Access to the published event is valid for 6 months from the payment date

4.2 Payment Processing

Payments are securely processed through Stripe. By making a payment, you agree to Stripe's terms of service.

4.3 Refund Policy

Due to the digital nature of the service, we generally do not offer refunds once an event has been published. However, we will consider refund requests in the following circumstances:

• Technical issues that prevent use of the service
• Duplicate or erroneous charges
• Requests made within 24 hours of payment

To request a refund, contact our support team with details of your case.

4.4 Price Changes

We reserve the right to modify our prices at any time. Price changes will not affect already paid events.

5. User Content

5.1 Content Ownership

You retain all ownership rights to the content you upload to the platform (texts, images, videos, etc.). By uploading content, you grant us a limited, non-exclusive, and revocable license to:

• Store and display your content on the platform
• Process and optimize your content for display
• Allow your guests to access your event content

5.2 Content Responsibility

You are solely responsible for the content you publish. You agree to:

• Not upload illegal, offensive, or content that violates third-party rights
• Not share sensitive personal information of third parties without their consent
• Have the necessary rights to use and share the content you upload
• Not infringe copyrights, trademarks, or other intellectual property rights

5.3 Content Removal

We reserve the right to remove any content that violates these terms or that we deem inappropriate, without prior notice.

6. Prohibited Uses

You are not permitted to use the platform for:

• Illegal or fraudulent activities
• Harassing, threatening, or intimidating other users
• Distributing spam, malware, or malicious content
• Attempting unauthorized access to accounts or systems
• Reverse engineering or attempting to copy the platform
• Using bots, scripts, or unauthorized automation
• Collecting data from other users without their consent
• Publishing defamatory, obscene, or discriminatory content
• Impersonating another person or entity
• Interfering with the normal operation of the service

7. Intellectual Property

The Invita Fiestas platform, including its design, code, logos, trademarks, and original content, is owned by Invita Fiestas and is protected by intellectual property laws.

You are not granted any ownership rights to the platform. You only have the right to use the service according to these terms.

8. Service Availability

We strive to keep the service available 24/7, but we do not guarantee that the service will always be available, uninterrupted, or error-free.

We may:

• Perform scheduled or emergency maintenance
• Experience interruptions due to technical issues
• Temporarily suspend the service for security reasons

We will make reasonable efforts to notify about scheduled maintenance in advance.

9. Limitation of Liability

To the maximum extent permitted by law, Invita Fiestas shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of data, profits, or business opportunities
• User-generated content
• Service interruptions or technical errors
• Actions of third parties (payment providers, hosting services, etc.)

The service is provided "as is" and "as available", without warranties of any kind, express or implied.

10. Indemnification

You agree to indemnify and hold harmless Invita Fiestas, its directors, employees, and affiliates from any claim, damage, loss, or expense (including reasonable legal fees) arising from:

• Your use of the service
• Your violation of these terms
• Your violation of third-party rights
• Content you publish on the platform

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without prior notice.

We may also update these Terms of Service occasionally. We will notify you of significant changes by posting the new terms on this page and updating the "Last updated" date.

Your continued use of the service after changes to the terms constitutes your acceptance of the new terms.

12. Termination

12.1 Termination by You

You can close your account at any time from your account settings. Upon closing your account:

• You will lose access to all your events and data
• Published events will remain active until their expiration date
• No refunds will be provided for already paid events

12.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms of Service
• You use the service fraudulently or illegally
• Your conduct harms other users or the platform
• You fail to pay applicable fees

13. Governing Law

These terms are governed by the laws of Mexico. Any dispute related to these terms or use of the service shall be resolved in the competent courts of Mexico.

If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
